Mr. Straus,

At the request of Jerry Simms, your client, I have been asked to communicate with you about the FBI’s investigation surrounding (strikeout) and Mark L. Nathanson, who previously sat as an appointed member on the California State Coastal Commission. As you are aware, Jerry Simms was a government witness in the investigation who provided material assistance resulting in not only criminal charges being brought but also search warrants being executed at the personal residence of both (strikeout) and Nathanson.

While the investigation was pending (for several years noting it is now closed), I was the case agent directly responsible for the investigation/prosecution. At "no" time did anyone bring to my attention "any" evidence suggesting Jerry Simms was a co-conspirator who acted in consort with (strikeout) or Nathanson.

This can be said for the periods both during and after the investigation/prosecution concluded. In fact, the FBI's view of Jerry Simms "never" changed even after (strikeout) cooperated in the investigation/prosecution and ultimately pled to racketeering charges, as did Nathanson.

Accordingly, I hope this clears up any misunderstanding or theory alluding to Jerry Simms being a co-conspirator of (strikeout) or Nathanson.
